Scope of data processing

The personal data is processed exclusively for the purpose of enabling the services requested by the users and for the scope of operating the website and selling our goods via the online shop. Furthermore, the personal data is collected and processed for the purpose of fulfilling fiscal and accounting obligations. In particular, we process the data we require to fulfill our contractual obligations, such as name, address, e-mail address, ordered products, invoice and payment data.  

You can also create a user account on our website. For the new registration we collect your personal data (e.g. name, address), communication data (e.g. e-mail address) and payment data (bank details) as well as access data (user name and password), which are necessary to guarantee this service.

Modalities of data processing

a) The processing of data refers to any kind of processing operation respectively any set of operations that are described in Art. 4, para. 1, lit. a) of the Italian Privacy Codex: Elicitation, storage, organization, retention, query, elaboration, modification, selection, retrieval, comparison, utilization, interconnection, blocking, communication, dissemination, erasure and destruction of data.

b) The processing operation can be carried out with or without the help of electronic or automated means.

c) The personal data of the users is processed by the entitled person and/or by persons in charge of the processing.

Legal basis for the data processing

The legal basis for the data processing is Art. 6, para. 1, lit. b of the GDPR (completion of a contract), as the processing of the personal data is necessary for the performance of the services requested by the users and the fulfillment of the contracts. Insofar as processing of personal data is required to fulfill a legal obligation that the Company Auer Othmar OHG & Co.  is subject to, Art. 6 para. 1 lit. c GDPR is the legal basis.

The legal basis for the processing of your data regarding the user account is your consent in accordance with Art. 6 Paragraph 1 S. 1 a) GDPR. Refusal to disclose personal data

If the user should refuse to provide the personal data according to paragraph 4, it will be impossible for the Company Auer Othmar OHG & Co. to prosecute the services, in particular the sale of the goods via the online shop, indicated in paragraph 2.

Duration of storage

The personal data, which is processed for the purposes indicated in paragraph 2, will be stored for the duration of the order or the contract and by all means for as long as required by legal regulations and ordinances, to which the Company Auer Othmar OHG & Co. is subject.

Personal data that is processed for advertising efforts and marketing communications will be stored until withdrawal of the consent by the person concerned or, if such withdrawal has not been communicated, for a specified maximum period that is considered to be appropriate.

According to Art. 16, the persons concerned are entitled to obtain the immediate rectification of data concerning them; the user has furthermore the right to obtain the cancellation of the data (Art. 17 GDPR) and to demand the restriction of the data processing (Art. 18 GDPR). Moreover, the person concerned is entitled to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided (Art 20 GDPR). The user has furthermore the right pursuant to Art. 21 GDPR to object at any time to processing of personal data.

The data subject has the right to revoke the consent at any time; the revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation.

In addition, there is a right of appeal to the data protection supervisory authority (Autorità Garante per la protezione dei dati personali – www.garanteprivacy.it) according to Art. 77 GDPR.
